The Justice Ministry disagrees with the Prosecutors’ Chamber of the Supreme Judicial Council which saw contradictions in the legislation, regulating the mechanism for accountability of the prosecutor general, said Deputy Justice Minister Emil Dechev in Parliament on Thursday.
On Wednesday, the Prosecutors Chamber refused to appoint for a second time judge Daniela Taleva for investigating prosecutor in connection with the first signal against a prosecutor general. It was filed against acting Prosecutor General Borislav Sarafov, while he served as a deputy prosecutor general. The Chamber see a conflict between the Judicial System Act and the Code of Penal Procedure.
According to Dechev, the law is clear that the ad hoc prosecutor is a prosecutor who can investigate a deputy of the prosecutor general and an interim prosecutor general.
The Deputy Justice Minister said that the refusal of the members of the chamber to appoint Taleva may affect Bulgaria’s entry into Schengen because some countries condition Bulgaria’s membership on an efficient mechanism for investigation of the prosecutor general, added Dechev. It may also affect money under the National Recover and Resilience Plan.
